Appendix 1 to the Rules of Sale for Personalised Products

Special rules for personalized products from

KUBOTA S.A.

  1. The Seller offers products that can be personalised by the Buyer. This can be done, among other things, by adding their own content.
  2. The seller reserves the right to remove inappropriate language and names associated with other brands.
  3. The Buyer may not use, transmit, submit, copy or otherwise make public any names, words or phrases that:
    1. constitute or contain the name of a product, service, company, organisation or event the legal owner of which is another entity;
    2. constitute or contain the name or nickname of a famous person (living or deceased);
    3. infringe or may infringe the trademark rights or other intellectual property rights of third parties;
    4. contain threats, incite violence, defame, are obscene, discriminatory, pornographic or otherwise unlawful;
    5. or otherwise are unacceptable to the Seller.
  4. The seller reserves the right to reject in the personalisation service, names, words and phrases (or combinations thereof) that fall into any of the above categories. This will result in cancellation of the order. Furthermore, in such cases, the Seller will be entitled to claim compensation equal to the value of the products ordered.
  5. By ordering personalised products, the buyer simultaneously agrees to:
    1. to certify and warrant that any names, words or phrases used, transmitted, represented, copied or otherwise made public through a personalised product designed by the Buyer do not fall into any of the above categories;
    2. indemnifying (to the extent permitted by applicable law) the Seller from and against all costs, expenses, damages, losses and liabilities incurred or suffered by the Seller as a result of the use of any names, words or phrases used, sent, filed, copied or otherwise made public by the Buyer (including use on personalised products);
    3. placing custom-made personalised flip-flops on the Vendor’s website, on social media operated by the Vendor and in all other advertising materials for marketing purposes.
  6. At the request of the Buyer, the Seller shall prepare a maximum of 3 visualisations on the basis of the materials and instructions provided by the Buyer. For each additional visualisation, the Seller shall be entitled to charge an additional fee.
  7. Depending on the complexity of the marking on the flip-flops, the Seller will inform the Buyer of this, which may entail the right to charge an additional fee.
